This presentation is intended to be a how to guide to architectural requests that goes deeper than the standard surface level content. The presentation will start with standard information on authority to require architectural review—i.e., the authority must be contained in the declaration—and may even evaluate varying examples of declaration language to compare the scope of architectural review authority granted. From there the presentation will look at case law examples to discuss how NC courts have handled architectural review in the past, specifically, we will dive into case law discussing authority to require construction bonds and what associations are required to include in denials based on the specific language of the declaration. We will also discuss how solar panel review differs from standard architectural requests, specifically how NC statutes may carry the day despite language in the declaration. Finally, the presentation will wrap up with enforcement discussion and provide practical strategies for enforcement specifically considering the context of architectural review—i.e., if an improvement is installed without approval is it prudent to require an improvement be removed when a small modification to the improvement would have resulted in the request being approved.
