On Demand: Best Practices for Terminating Your Vendor Contracts (2026 Law Day)

This presentation provides an overview of the legal system, including what happens when a lawsuit is filed, important deadlines to be aware of, and protocols to follow when a lawsuit is filed.  The speakers will cover the attorney-client privilege, which is important to enable the attorney to speak with the board, and sometimes, with the property manager.  Managers and boards will also receive guidance about best-practices to follow before a lawsuit is ever filed, such as using HOA-specific emails for all board communications, and about the risks of communicating by text message or social media. Managers and Boards will also receive information about the discovery phase in a lawsuit, including the obligation to respond to discovery requests, an obligation to designate at least one representative to sit for depositions, and what “motions practice” means.  A discussion of what happens during a trial will also be provided.  The speakers will also describe judgments, appeals, and unique considerations applicable to many condominiums. Finally, the speakers will discuss the importance of insurance, and the costs of a lawsuit, and the types of information that can be provided to members after a lawsuit is filed.
